Proposal for a law to regulate divorce proceedings and annulment of marriage through a uniform civil track in Israel.

📖 Background
In the State of Israel, there is a legal distinction between spouses who belong to the same religion and those who belong to different religions or are without religion.
When the spouses belong to different religions, or when one or both of them are without religion, it is possible to initiate a procedure for obtaining a divorce in the Family Court.
On the other hand, when both spouses are Jewish, the divorce procedure is under the exclusive jurisdiction of the Rabbinical Court, in accordance with the existing law.
The existing legal situation creates parallel legal systems in family matters, including child custody, property division, alimony, and other issues.
This split between the Family Courts and the religious courts may create a lack of uniformity in the law and discrimination between citizens based on religious affiliation.
📝 Proposal text
מוצע לחוקק חוק אזרחי אחיד אשר יסדיר את כלל הליכי הגירושין והתרת הנישואין בישראל, לרבות:
חלוקת רכוש,
משמורת ילדים,
מזונות,
והליכי פרידה נוספים,
וזאת במסגרת אזרחית שווה לכלל אזרחי ישראל, ללא הבחנה דתית.
מטרת ההצעה היא לחזק את עקרון השוויון בפני החוק, הנחשב לאחד מעקרונות היסוד של משטר דמוקרטי, ולהבטיח זכויות וחובות שוות לכלל אזרחי המדינה.

- + יש ליצור מסלול אזרחי אחיד בענייני משפחה לכלל אזרחי ישראל, ללא קשר לדתם או למגזר שאליו הם משתייכים.
- + שינוי זה יקדם שוויון זכויות, יפחית אפליה וייצור אחידות משפטית במדינה דמוקרטית.
